The RTLinux software and patent themselves have always been 100%
compliant/compatible. The problem is with "registration"-like
issues with the patent license by commercial users or resellers. It
conflicts with the GPL.

It has now been resolved.

IMHO, FSMLabs is a model company that other GPL licensed, commercial
ventures should follow. They have improved upon what companies like
Cygnus (now owned by RedHat) have done with GPL. They commercially
license their RTOS approach to other vendors, including Lineo and
two vendors that added RT extensions to Windows NT.
